| Resumo: | O presente trabalho tem como objetivo o estudo dos diversos modelos familiares existentes na Constituição Federal de 1988, em especial das novas famílias que surgiram recentemente, por intermédio da análise dos princípios constitucionais e direitos fundamentais relacionados ao tema. O assunto será discutido, em primeiro lugar, através de uma análise da família e sua evolução ao longo da história, desde a antiguidade até os dias atuais, destacando-se as evoluções sofridas por essa instituição social. Posteriormente, o estudo se voltará para análise da proteção dada à família em todas as Constituições brasileiras, bem como nos diversos diplomas internacionais de proteção dos direitos humanos. Com o intuito de se destacar a relevância dos novos modelos familiares em nossa sociedade atual será salientada a importância da família como base da sociedade e instrumento de desenvolvimento da personalidade de seus integrantes, através de uma visão abrangente dos princípios constitucionais e direitos fundamentais previstos em nossa Constituição.Em relação ao tema proposto, ao final será feito um estudo da afetividade como fator importante para o reconhecimento das novas famílias. Também será realizada uma análise da Constituição como um sistema aberto, além da importância da interpretação constitucional como instrumento de inclusão de todas as entidades familiares e a mutação sofrida no conceito de família. Por fim, será desenvolvida uma breve análise dos diversos tipos de famílias atualmente existentes, trazendo-se para estudo as mais recentes decisões de nossos tribunais e inovações na legislação infraconstitucional. O desenvolvimento do tema na forma proposta procura enfrentar as principais questões relativas ao tema e assegurar uma visão inclusiva de todas as formas de família existentes pelo texto da Constituição de 1988 |
| Abstract: | The present paper has as a purpose the study of the several existing familiar models in the Federal Constitution of 1988, especially of the new families who have recently appeared, by means of the analysis of the constitutional principles and fundamental laws related to the subject. The subject will be argued, in first place, through an analysis of the family and its evolution throughout history, since the antiquity until the current days, emphasizing the evolutions suffered for this social institution. Later, the study will turn toward the analysis of the protection given to the family in all the Brazilian Constitutions, as well as in the several international diplomas of protection of the human rights. With the intention of emphasizing the relevance of the new familiar models in our current society, it will be pointed out the importance of the family as base of the society and instrument of development of the personality of its integrants, through an including vision of the constitutional principles and fundamental laws contained in our Constitution. Regarding the proposed subject, to the end it will also be made a study of the affectivity as an important factor for the recognition of the new families. Also an analysis of the Constitution as an opened system will be made, as well as the importance of the constitutional interpretation as instrument of inclusion of all the familiar entities and the mutation suffered in the family concept. Finally, one brief analysis of the diverse types of currently existing families will be developed, bringing for study the most recent decisions of our courts and innovations in the legislation. The development of the subject in the form as purposed looks for to face up the main relative questions to the subject and to assure an inclusive vision of all the existing forms of family in the text of the Constitution of 1988 |
