A união estável no direito brasileiro e o novo Código Civil

Abstract

The work had the purpose to present the new family entity, denominated Stable Union and the innovations brought by the New Civil Cede (Iaw 10.406 of January 10, 2002). Previously it was made a historical and chronological analysis of the relationship among people no married, living as they intended to be, in the old Civil Cede, in the Federal Constitution and in the ordinary laws that disciplined this new family type. The most relevant aspects were presented, mainly, the relativa ones to the succession among connivents. It was treated, still, on the other hand, of a relationship very commom nowadays the union netween people of the sarna sex, called in Portuguesa União Homoafetiva that has been causing warm debates in the civil society, generating rejection in the moralists and a rational attitude of those that recognize such union in fact as a reality, as it is truly. The jurisprudence has manifested concerning this theme, mainly in what it concerns to the patrimony division, when a member of this society dias in the validity of the relationship, and in terms of social security. It was the target to present the dissertation to be didactic, and at the sarna time, to emphasize the critic with the opinion of several eminent jurists who has given to the modest work a pertinent character to the object of the chosen theme. This work had a special feature what consisted in showing enphatically the patrimony after the death of one of the conivents or at the end of the stable union
