| Título: | A função retórica heurística nos debates perante o tribunal do júri - uma visão aristotélica |

| Resumo: | O objetivo do presente trabalho é o estudo da arte retórica mediante seus elementos e características fundamentais. Para tanto, partindo do livro, Retórica, de Aristóteles, abordamos um pouco da vida, da história e da obra deste grande pensador grego, que revolucionou as artes, o pensamento e a politica de sua época. Em especial o endoxa, a academia e o peripatetismo aristotélico. Utilizando-se das lições de Aristóteles e de outros pensadores modernos, que estudaram a sua obra, como Chain Perelman e Olivier Reboul, passamos também a estudar a Argumentação e seus elementos. Iniciamos por discutir os elementos Retórica e Dialética; descrevemos as espécies de retórica e a suas funções dentro do discurso. Dentro das funções da retórica, uma delas se tornou especial para o nosso trabalho, qual seja, a Função Heurística, isto é, a busca da verdade no discurso. Deste modo passamos a conceituar a verdade, com toda complexidade que o tema sugere e a esmiuçar a retórica heurística. Dentro deste panorama, partimos para a procura de um discurso em especial para desenvolver o tema Heurística, na prática. Assim, nos situamos em um discurso especifico, qual seja, aquele travado nos debates orais perante o Tribunal do Júri. Nesse sentido, desenvolvemos o tema Júri, em especial a sua origem, a sua evolução histórica e a instituição no Brasil. Abordamos o julgamento e os debates em plenário e a busca da retórica heurística dentro do discurso judicial. Para nos auxiliar nesta proposição tomamos um caso real de repercussão no Tribunal do Juri, para exemplificar e mostrar de forma pratica os elementos retóricos do discurso em especial a heurística, que é a busca da verdade. Permitimos-nos então chegar a algumas conclusões acerca do tema Retórica e sobre a Verdade no Discurso Judicial. |
| Abstract: | ABSTRACT The objective of the present work is the study of the rhetorical art through its elements and fundamental characteristics. In order to do that the book Rhetoric, written by Aristotle, we approach this great Greek thinker s life, history and the work. He revolutionized the arts, the thoughts and the politics on his time. Specially endoxa , the academy and the aristotelian peripatetismo . Making use of the Aristotle s and other modern thinkers thougts who studied his work, as well as Chain Perelman and Oliver Reboul, we also decided to study the Argumentation and its elements. At first we discussed of Rhetoric and Dialectic elements, we describe the different kinds of rhetoric and its functions of the speech. Concerning rhetoric functions, one of them became special for our work, which is the Heuristical Function, that is, the search for the truth in the speech. We started to consider the truth, with all complexity that the theme suggests and to detail the heuristical rhetoric. Within this panorama, we started to look for a special speech to develop the Heuristical theme, in practice. So, we find ourselves in a specific speech, which is carried out in the oral debates in the Jury Court. Concerning this, we developed the theme Jury specially its origin, its historical evolution and the institution in Brazil. We approached the judgment and plenary session debates and the search for the heuristical rhetoric within the judicial speech. We took a real case with repercussion in the Jury Court, to exemplify and to show the rhetorical elements of the speech, in a functional way, specially the heuristic, that is the search of the truth. |
