| Resumo: | O trabalho desenvolve-se a partir da disposição inserida no artigo 5º , caput da Constituição da República Federativa do Brasil que dispõe todos são iguais perante a lei, sem distinção de qualquer natureza, garantindo-se aos brasileiros e aos estrangeiros residentes no País a inviolabilidade do direito à vida, à liberdade, à igualdade, à segurança e à propriedade ... O estudo tem o escopo de verificar como a igualdade, estabelecida na Constituição da República Federativa do Brasil, transmite-se ao processo penal e à jurisdição, que por sua vez a conduz ao devido processo legal . Abordamos, de início, aspectos históricos referentes ao instituto da Revisão Criminal , nas várias civilizações e no direito pátrio, em razão dos brocardos que praticamente deram origem ao instituto, e posteriormente tiveram seus conceitos aprofundados através do desenvolvimento das teorias antigas e modernas |
| Abstract: | The work grows starting from the disposition inserted in the article 5th, caput of the Constitution of the República Federativa of Brazil that disposes "all they are same before the law, without distinction of any nature, being guaranteed to the Brazilians and the resident foreigners in the Country the inviolability of the right to the life, to the freedom, to the equality, to the safety and the property..." The study has the mark of verifying as the equality, established in the Constitution of the República Federativa of Brazil, it is transmitted to the penal process and the jurisdiction, that it leads her/it to the due legal process for your time. We approached, at the beginning, referring historical aspects to the institute of the Criminal Revision, in the several civilizations and in the right pátrio, in reason of the brocardos that practically gave origin to the institute, and later they had your concepts deepened through the development of the old and modern theories |
