| Título: | Biodireito constitucional: intimidade e integridade na era genética |

| Resumo: | O objetivo é revelar e confrontar os avanços da biotecnologia e da biomedicina, verificando os interesses jurídicos que têm se expandido em realidades complexas numa dimensão individual e coletiva. A proteção jurídica eficaz de bens jurídicos complexos, abordados a partir dos parâmetros característicos dos direitos fundamentais e dos direitos humanos presentes num conjunto de regras internacionais. O estudo fundamentou-se numa ampla pesquisa bibliográfica sobre as caracterização e definição das possibilidades no campo do genoma humano, da engenharia genética, dos elementos principais da bioética, o direito a integridade e intimidade, no plano individual e por reflexo, no coletivo, frente às realidades da biotecnologia. No estudo delimitou-se o papel dos direitos fundamentais no avanço da biotecnologia, verificando a necessidade de novos paradigmas jurídicos para contemplar novos elementos da biomedicina e seu desdobramento tecnológico. Debateu-se, ainda, a conceituação e limites sobre o patrimônio genético, e as intervenções sobre o genoma humano sob os aspectos eugênicos de melhoria da espécie humana, clonagem humana, direito à reprodução e a utilização das informações genéticas, individuais e coletivas, por particulares com fim de criação de banco de informação genética restritiva de direitos. O tema objeto de estudo é atual, principalmente pela inexistência de regra infraconstitucional, fazendo com que a Constituição de 1988, seja a limitadora imediata na ocorrência do caso concreto |
| Abstract: | The objective is to reveal and confront advances in biotechnology and biomedicine, checking the legal interests have expanded into complex realities in individual and collective dimensions. The effective legal protection of property complex legal, approached from the characteristic parameters of fundamental rights and human rights present a set of international rules. The study was based on a broad literature on the definition and characterization of the possibilities in the field of the human genome, genetic engineering, the main elements of bioethics, the right to integrity and intimacy, individually and by reflection, the collective front the realities of biotechnology. In the study narrowed the role of fundamental rights in the advancement of biotechnology, verifying the need for new paradigms to address new legal elements of biomedical technology and its deployment. She struggled, yet the concept and limits on genetic heritage, and interventions on the human genome under the eugenic aspects of improving the human species, human cloning, reproductive rights and the use of genetic information, individual and collective, by private in order to create database of genetic information restricting rights. The theme is the current object of study, especially the lack of infra rule, causing the 1988 Constitution, is limiting the immediate occurrence in the case |
