Abstract

This monograph focuses primarily on addressing the main legal consequences of abuse of power during the investigative phase for criminal procedure. Aim: To analyze the main legal consequences of abuse of power during the investigative phase for criminal procedure. Method: This study consists of applied research of an exploratory nature, iming to present and analyze the main legal consequences for criminal procedure that ay originate from the investigative phase when it is conducted abusively. Results: The esults will be presented qualitatively, based on the collection of information from secondary ources, including literature review and jurisprudential analysis of rulings and doctrinal positions of superior courts. As research sources, in order to gather the theoretical ramework, books, articles, documents, court rulings from collegiate decisions, and enowned authors in the criminal field, such as Guilherme de Souza Nucci, will be used.Discussion: Abuse of power during investigations undermines due process and may lead to nullities.
