Título: Direito à vida do embrião

Resumo: A presente tese enfrenta os desafios bioéticos em relação à garantia do direito à vida do nascituro, abordando o paradigma ontológico personalista, dentre outros, como o mais adequado para as grandes questões atinentes à vida humana. Discorre sobre os grandes marcos normativos internacionais e nacionais em relação ao tema, dedicando-se a examinar dentre eles aquelas de maior impacto mundial. Examina também a legislação interna e comparada, no âmbito do Direito Civil e Penal, bem como as normas administrativas relativas à saúde, sempre observando a valoração social da vida humana, em especial a do nascituro. Nesse sentido, destacam-se os aspectos biológicos do início da vida humana como anteparo científico para se identificar o seu marco inaugural. Especial destaque é dado à Convenção Americana dos Direitos Humanos, que dispõe sobre a proteção do direito à vida desde o momento da concepção. Os maiores desafios do debate bioético relativos ao início da vida, tais como a questão do aborto dos fetos com anencefalia, a pesquisa das células-tronco embrionárias e o tormentoso problema dos embriões excedentes das técnicas de reprodução humana assistida, além do exame dos julgados do Supremo Tribunal Federal nos autos da ADI n° 3510 e ADPF n° 54, contextualizam os enfrentamentos da atualidade. As normas constitucionais, internacionais e infraconstitucionais que já asseguram ao nascituro os seus direitos fundamentais não se demonstraram suficientes para fazer cessar tantas ameaças e violações a esses mesmos direitos fundamentais, sendo urgente a adoção de uma nova legislação versando, inclusive, sobre os dramáticos temas do aborto dos fetos com anencefalia, das manipulações genéticas com células-tronco embrionárias, e também a inquietante situação dos embriões, resultantes das técnicas de reprodução humana assistida, que permanecem sem destino em bancos dedicados a armazená-los como produtos excedentes. Como contribuição para o aprimoramento da normatização do assunto, apresenta-se, ao final, uma sugestão de lege ferenda, por meio de um Projeto de Lei articulado, buscando-se contemplar, principalmente, a inviolabilidade do direito à vida desde o momento da concepção. Conclui-se, por fim, que a vida humana, individual, inicia-se com a fecundação, o que justifica a sua proteção estatal desde esse momento, devendo-se, pois, adotar medidas urgentes para a tutela desse direito fundamental
Abstract: This thesis faces the bioethical challenges regarding the guarantee of the right to life of the unborn, and approaches the personalist ontological paradigm, among others, as the most suitable for the big issues pertaining to human life. It also discusses the major international and national normative frameworks about the theme, and examines, among them, those of greater global impact. Furthermore, it examines both the domestic legislation and Comparative Law under both Civil and Criminal Law, as well as the administrative rules concerning health, always observing the social valuation of human life, especially that of the unborn child. In this sense, the biological aspects of the beginning of human life are the solid scientific basis which identifies its origin. Special emphasis is given to the American Convention on Human Rights, which rules on the protection of the right to life from the moment of conception. The biggest challenges of the bioethical debate related to the beginning of life, such as the issue of abortion of anencephalic fetuses, the research of embryonic stem cells and the stormy issue of excess embryos after assisted human reproduction techniques, in addition to the examination of the adjudication of the Supreme Court in the records of ADI no. 3510 and ADPF no. 54, contextualize the current confrontation. Constitutional, international and infra-constitutional rules - which already secure the fundamental rights of the unborn - have not been sufficient to cease all threats to and violations of those same fundamental rights, and urge the adoption of new legislation on this matter, including the dramatic themes of abortion of anencephalic fetuses, genetic manipulations of embryonic stem cells, and also the unsettled situation of embryos resulting from the assisted human reproduction techniques, with no ultimate destination in banks dedicated to storing them as surplus products. At the end, as a contribution to the improvement of legal standardization of subject, this work presents de lege ferenda proposals in the form of a Bill, seeking to contemplate, in special, the inviolability of the right to life from the moment of conception. It is concluded that the individual human life begins at fertilization, which justifies its state protection since then and, therefore, the adoption of urgent measures for the protection of such a fundamental right
