dc.description.abstract | This study has the purpose of discussing the arbitration in the Labor Courts, as an alternative of conflict resolution, pointing the advantages and disadvantages of this institute, in order to verify that it really stands as an alternative to the solution of conflicts within the Labor Court. There is debate about application or not the arbitration regulated by the Federal Law 9.307/96, under the Labor Law. Do not missing arguments favorable or not, to use the method as a mechanism for resolving conflicts in the relationship between employee and employer. The application of legal arbitration in various segments occurs unquestionably in other areas of law, however, there are numerous disputes, that must be analyzed in many ways, and they may interact with each other or not. Also, have the present study in order to analyze the speed and privacy of it, also allows a more informal environment welcoming and facilitating many conflicts already worn by grievances are resolved in a much more satisfactory, given satisfactorily both interested. Its important to mention that the conduct of the labor still faces all sorts of difficulties in the three instances of the Labour Court, with their already crowded agendas of hearings and trials that are multiplying every day, can the implementation of alternative dispute resolution individual and collectives, such as mediation and arbitration, could represent a way out of the crisis plaguing Brazilian labor justice | en_US |
